ABSCHNITT 1 – ONLINE-SHOP-BEDINGUNGEN Mit dem Akzeptieren dieser Allgemeinen Geschäftsbedingungen bestätigen Sie, dass Sie in Ihrem Wohnsitzstaat oder -kanton volljährig sind oder uns Ihr Einverständnis gegeben haben, dass Ihre minderjährigen Angehörigen diese Website nutzen dürfen.

Sie dürfen unsere Produkte nicht für illegale oder unbefugte Zwecke verwenden und dürfen bei der Nutzung des Dienstes keine geltenden Gesetze verletzen.

ABSCHNITT 2 – ALLGEMEINE BEDINGUNGEN Wir behalten uns das Recht vor, den Service aus beliebigen Gründen jederzeit zu verweigern. Ihre Inhalte (ohne Kreditkarteninformationen) können unverschlüsselt über verschiedene Netzwerke übertragen werden. Kreditkarteninformationen werden jedoch immer verschlüsselt übertragen.

ABSCHNITT 3 – GENAUIGKEIT DER INFORMATIONEN Wir übernehmen keine Gewähr für die Richtigkeit, Vollständigkeit oder Aktualität der Informationen auf dieser Website.

ABSCHNITT 12 – VERBOTENE VERWENDUNGEN Es ist untersagt, die Seite oder deren Inhalte für illegale Zwecke zu nutzen, Gesetze zu verletzen, Rechte Dritter zu beeinträchtigen oder Sicherheitsfunktionen zu umgehen.

ABSCHNITT 13 – VERSAND- UND RÜCKGABEBEDINGUNGEN Wir verkaufen lebende Pflanzen. Daher sind Rückgaben oder Rückerstattungen grundsätzlich ausgeschlossen, es sei denn, ein Schaden wurde eindeutig durch uns verursacht. Pflanzen sind Naturprodukte und können in Form, Grösse oder Farbe variieren. Mit Ihrer Bestellung erkennen Sie an, dass solche natürlichen Abweichungen oder kleinere Mängel keinen Reklamationsgrund darstellen.

Internationale Bestellungen verschicken wir ausschliesslich montags oder dienstags. Bestellungen innerhalb der Schweiz versenden wir von Montag bis Mittwoch, um lange Laufzeiten über das Wochenende zu vermeiden.

Wir bemühen uns, so schnell wie möglich zu versenden (in der Regel innerhalb weniger Tage). Wenn Sie z. B. an einem Dienstag bestellen, kann Ihre Bestellung am darauffolgenden Montag versendet werden. Wir bitten um Geduld.

Bei niedrigen Temperaturen verwenden wir 40- oder 72-Stunden-Heatpacks, um einen sicheren Versand zu gewährleisten.

Bei extremen Wetterbedingungen behalten wir uns das Recht vor, den Versand zu verschieben.

Wir verpacken sorgfältig. Sollte eine Pflanze dennoch beschädigt bei Ihnen ankommen, senden Sie uns bitte umgehend ein Foto von der Verpackung und dem Inhalt an info@variegated-stingray.com. Wir finden gemeinsam eine Lösung.

Rückerstattungen erfolgen nur, wenn die Pflanze sich im Originalzustand befindet und eindeutig durch uns verursachte Schäden aufweist. Ein sofortiger Substratwechsel oder das Entfernen von Pflanzenteilen (Blätter oder Wurzeln) macht einen Rückgabeanspruch ungültig.

Für Rücksendungen verwenden Sie bitte die Originalverpackung und -polsterung und stimmen Sie den Zeitpunkt mit uns ab. Für unsachgemässe Rücksendungen übernehmen wir keine Haftung.

Kleinere Transportschäden wie eingerissene Blätter oder Verfärbungen berechtigen nicht zur Rückgabe.

ABSCHNITT 14 – URHEBERRECHT Die Urheber- und alle anderen Rechte an Inhalten, Bildern, Fotos oder anderen Dateien auf der Webseite gehören ausschliesslich Variegated Stingray bzw. www.variegated-stingray.ch oder den speziell genannten Rechtsinhabern. Für die Reproduktion jeglicher Elemente ist die schriftliche Zustimmung der Urheberrechtsträger im Voraus einzuholen.

ABSCHNITT 15 – HAFTUNGSAUSSCHLUSS Wir garantieren nicht, dass der Service unterbrechungsfrei oder fehlerfrei ist. Die Nutzung erfolgt auf eigenes Risiko. Unsere Haftung ist auf das gesetzlich zulässige Mass beschränkt.

ABSCHNITT 16 – SCHADLOSHALTUNG Sie erklären sich damit einverstanden, Variegated Stingray schadlos zu halten von jeglichen Ansprüchen Dritter, die durch Ihren Verstoss gegen diese Bedingungen entstehen.

ABSCHNITT 17 – SALVATORISCHE KLAUSEL Sollte eine Bestimmung dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

ABSCHNITT 18 – KÜNDIGUNG Diese Bedingungen gelten bis zu ihrer Kündigung durch Sie oder uns. Sie können diese jederzeit durch Mitteilung oder Einstellung der Nutzung kündigen.

ABSCHNITT 19 – GESAMTVEREINBARUNG Diese AGB stellen die vollständige Vereinbarung zwischen Ihnen und uns dar und ersetzen alle vorherigen Absprachen.

ABSCHNITT 20 – ANWENDBARES RECHT Diese Bedingungen unterliegen dem Recht der Schweiz.

SECTION 1 – ONLINE STORE TERMS By agreeing to these Terms and Conditions, you confirm that you are at least the age of majority in your state or province of residence, or that you have given us your consent to allow any of your minor dependents to use this website.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction.

Your content (excluding credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.

SECTION 6 – BILLING AND ACCOUNT INFORMATION We reserve the right to refuse any order you place with us. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

SECTION 7 – OPTIONAL TOOLS We may provide you with access to third-party tools over which we neither monitor nor have any control or input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties or endorsements.

SECTION 8 – THIRD-PARTY LINKS Some content, products and services available via our Service may include materials from third parties. We are not responsible for examining or evaluating the content or accuracy, and we do not warrant and will not have any liability or responsibility for third-party materials or websites.

SECTION 9 – USER COMMENTS AND SUBMISSIONS Any submissions (comments, suggestions, ideas) you send us may be used by us without restriction. You agree that your comments will not violate any right of any third party.

SECTION 11 – ERRORS AND INACCURACIES We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.

SECTION 12 – PROHIBITED USES You are prohibited from using the site or its content for unlawful purposes, to violate laws, infringe on intellectual property rights, harass or discriminate, upload viruses, collect personal data of others, spam, or interfere with security features.

SECTION 13 – SHIPPING AND RETURN CONDITIONS We sell living plants. Therefore, we generally exclude returns or refunds unless damage is clearly our responsibility. Plants are natural products and may vary in shape, size, or color. By placing an order, you acknowledge that such natural variation or minor imperfections do not constitute grounds for return or refund. We ship all international orders exclusively on Mondays or Tuesdays. Domestic orders (within Switzerland) are shipped from Monday to Wednesday to avoid long transit times over weekends.

We aim to ship as quickly as possible (usually within a few days). If you place your order on a Tuesday, it may be shipped the following Monday. We kindly ask for your patience.

If temperatures require it, we will pack your plants or seeds with a 40- or 72-hour heat pack to ensure safe delivery even in cold weather.

In case of extreme weather conditions in winter or summer, we reserve the right to postpone shipping until conditions are safe for plant transport.

We pack all items carefully. However, if a plant arrives damaged, please send us a photo of the packaging and its contents to info@variegated-stingray.com as soon as possible. We will get back to you to find a solution.

Please note that refunds will only be granted if the plant is still in its original condition and shows clear damage for which we are responsible. Immediate repotting or removal of plant parts (leaves or roots) voids your right to a return.

Always use the original packaging and padding for returns and coordinate the return with us. We cannot offer refunds for damages caused by improper repackaging.

Minor transport damage such as torn leaves or discoloration is not grounds for a refund.

SECTION 14 – INTELLECTUAL PROPERTY / COPYRIGHT All copyrights and other rights to content, images, photographs, or other files on this website belong exclusively to Variegated Stingray and www.variegated-stingray.ch or the specifically named rights holders. Any reproduction, modification, or distribution of any elements requires prior written consent of the copyright holder.

SECTION 15 – DISCLAIMER OF WARRANTIES We do not guarantee that the service will be uninterrupted or error-free. Your use of the service is at your sole risk. Liability is limited to the extent permitted by law.

SECTION 16 – INDEMNIFICATION You agree to indemnify and hold harmless Variegated Stingray from any claims or demands made by any third party due to your breach of these Terms.

SECTION 17 – SEVERABILITY If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain in effect.

SECTION 18 – TERMINATION These Terms are effective unless and until terminated by either you or us. You may terminate by notifying us or ceasing use of our site.
